This privacy policy explains to you the type, scope and purpose of the processing of personal data (hereinafter referred to as "data") within my online offer and the associated websites, functions and contents as well as external online presences, e.g. my social media profile (hereinafter jointly referred to as "online offer"). With regard to the terms used, such as "processing" or "controller", I refer to the definitions in Art. 4 of the EU Data Protection  (EUDATAP).

As the operator of these pages, I take the protection of your personal data very seriously. I treat your personal data confidentially and in accordance with the legal data protection regulations and this data protection declaration. All data protection laws and regulations are strictly observed.

The use of my website is usually possible without providing personal data. As far as on my pages personal data (for example name, address or e-mail addresses) are collected, this is done, as far as possible, always on a voluntary basis. This data will not be passed on to third parties without your express consent.

Terms used

"Personal data" means any information relating to an identified or identifiable natural person (hereinafter referred to as "data subject"); an identifiable natural person is one who can be identified directly or indirectly, in particular by assignment to an identification such as a name, an identification number, location data, an online identification (e.g. cookie) or to one or more special features that express the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person.

"Processing" means any operation or series of operations carried out with or without the aid of automated procedures in connection with personal data. The term is wide-ranging and covers practically every handling of data.

"Pseudonymisation" means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

"Profiling" means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements.

"Controller" means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Governing legal provisions

In accordance with Art. 13 EUDATAP, I inform you of the legal base of my data processing. If the legal basis is not mentioned in the data protection declaration, the following applies:

The legal basis for obtaining consents is Art. 6 para. 1 lit. a and Art. 7 EUDATAP, the legal basis for processing for the provision of my services and the execution of contractual measures and for the answers to enquiries is Art. 6 para. 1 lit. b EUDATAP, the legal basis for processing for the fulfillment of my legal obligations is Art. 6 para. 1 lit. c EUDATAP, and the legal basis for processing to protect my legitimate interests is Art. 6 para. 1 lit. f EUDATAP. In the event that the vital interests of a person concerned or another natural person require the processing of personal data, Article 6(1)(d) EUDATAP serves as the legal basis.

In addition to the EUDATAP, the German Telemedia Act (TMG), the German Federal Data Protection Act (BDSG) and the applicable legal provisions of the German Telecommunications Act (§§ 85 ff. TKG) were taken into account with regard to data protection laws.

Safety precautions

I shall take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk, taking into account the state of the art, the costs of implementation and the nature, scope, circumstances and purposes of processing and the different likelihood and severity of the risk to the rights and freedoms of natural persons, in accordance with Article 32 EUDATAP.

Such measures shall in particular include ensuring the confidentiality, integrity and availability of data by controlling physical access to the data, as well as the access, input, transmission, security of availability and its separation. I have also set up procedures to ensure that the rights of individuals concerned are exercised, that the deletion of data is guaranteed and that a reaction is triggered if the data is endangered.

Furthermore, I already consider the protection of personal data during the development or selection of hardware, software and procedures in accordance with the principle of data protection through technology design and data protection-friendly presets (Art. 25 EUDATAP).

Cooperation with contract processors and third parties

If I disclose data to other persons and companies (contract processors or third parties) within the scope of my processing, transfer them to them or otherwise grant them access to the data, this shall only take place on the basis of a legal permission (e.g. if a transfer of the data to third parties, such as payment service providers, pursuant to Art. 6 para. 1 lit. b EUDATAP for contract performance is required), if you have consented, if a legal obligation provides for this, or on the basis of my legitimate interests (e.g. when using agents, web hosters, etc.).

If I commission third parties with the processing of data on the basis of a so-called "Data Processing Agreement", this shall be done on the basis of Art. 28 EUDATAP.

Forwarding of data to third countries

If I process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or this happens in the context of the use of third-party services or disclosure or transfer of data to third parties, this only takes place if it happens to fulfill my (pre)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of my legitimate interests. Subject to legal or contractual permissions, I will process the data or have the data processed in a third country only if the special requirements of Art. 44 ff. EUDATAP are fulfilled. This means, processing is carried out for example on the basis of special guarantees, such as the officially recognised confirmation of a data protection level in accordance with the EU (e.g. for the USA under the Privacy Shield) or by observing officially acknowledged special contractual obligations (so-called "standard contractual clauses").

Rights of the individuals concerned

You have the right to request confirmation as to whether the data concerned are being processed and to request information about these data as well as further information and a copy of the data in accordance with Art. 15 EUDATAP.

In accordance with Art. 16 EUDATAP, you have the right to request the completion of your personal data or the correction of inaccurate data about you.

In accordance with Article 17 of the EUDATAP, you have the right to demand that relevant data be deleted immediately or, alternatively, to demand a curtailment of the processing of the data in accordance with Article 18 of the EUDATAP.

You have the right to request that you receive the data concerning you that you have provided to us in accordance with Art. 20 EUDATAP, and to request that it be forwarded to other parties responsible.

In accordance with Art. 77 EUDATAP, you also have the right to file a complaint with the relevant supervisory authority, if you believe that the processing of your data violates data protection law or if your data protection claims have otherwise been violated in any way. In Germany, the responsible supervisory authority for data protection issues is the data protection officer (Landesdatenschutzbeauftragte) of the federal state in which I am based. Right of appeal

You can object to the future processing of the data concerning you in accordance with Art. 21 EUDATAP at any time. The objection may be lodged in particular against processing for direct marketing purposes.

Encryption using SSL or TLS

For security reasons, this website uses SSL encryption ('Secure Sockets Layer'). This is to protect transmitted data so that it cannot be read by third parties. You can detect successful encryption by a change in the protocol name in the browser's status bar from "http" to "https", and by a closed lock symbol being visible there.

Each time a user accesses the site, his or her Internet browser transmits access data, which is automatically stored in log files, the so-called server log files. These data will not be merged with other data sources, in particular with personal user data. The log files contain the following information:

An IP address by which the computer (but not the user) can be identified, the remote host (name and IP address of the computer requesting the page), the time, the status, the amount of data transmitted, and the Internet page from which the user has reached the requested page (referrer), as well as product and version information of the browser used (user agent). With this data it is possible to trace, in which areas I can improve my Internet offer for the readers, which contents are being read and which remain unread.

I must point out that data transmission via the Internet (e.g. when communicating by e-mail) can have security gaps. A complete protection of the data against access by third parties is unfortunately not possible.

Cookies

My pages use so-called cookies. A cookie is an entry in a data directory on your computer. Cookies do not cause any damage to your computer and do not contain any viruses. Cookies are used to make my website user-friendly. Most of the cookies I use are so-called "session cookies". They are automatically deleted at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies enable me to recognize your browser on your next visit. Occasionally I also use temporary cookies so that I can support you more effectively to return to a website.

A general objection to the use of cookies used for online marketing purposes can be declared for a variety of services, especially in the case of tracking, via this US site or this EU site.

When cookies are deactivated, the functionality of this website may be limited. Please note that in this case it is possible that not all functions of this online offer can be used.

Deletion of data

The data I process will be deleted or its processing will be restricted in accordance with Articles 17 and 18 DSGVO. Unless expressly stated in this Privacy Policy, the data stored by me will be deleted as soon as they are not required for their intended use and the deletion does not conflict with any legal storage obligations. If the data are not deleted because they are necessary for other and legally permissible purposes, their processing will be restricted. This implies that the data is locked and will not be processed for other purposes. This is the case, for example, for data that must be retained for commercial law or tax law requirements.

According to legal requirements in Germany, the storage is done in particular for 10 years according to §§ 147 para. 1 AO, 257 para. 1 no. 1 and 4, para. 4 HGB (Handelsgesetzbuch - German Commercial Code) (for books, records, management reports, accounting documents, trading books, documents relevant for taxation, etc.) and 6 years according to § 257 para. 1 no. 2 and 3, para. 4 HGB (for commercial letters).

In accordance with legal requirements in Austria, storage is carried out in particular for 7 years in accordance with § 132 (1) BAO (Bundesabgabenordnung - Federal Tax Code) (for accounting documents, receipts/invoices, accounts, receipts, business papers, statement of income and expenses, etc.), for 22 years in connection with real estate and for 10 years for documents in connection with electronically provided services, telecommunications, radio and television services, which are provided to non-entrepreneurs in EU member states, and for which the Mini-One-Stop-Shop (MOSS) is used.

Business-specific processing

In addition, I process if necessary,
Contract data (for example, contract object, term, customer category)
Payment data (e.g. bank details, payment history)
by my customers, prospective customers and/or business partners for the purpose of providing contractual services, service and customer care, marketing, advertising and market research.

Comments and postings

If users leave comments or other contributions, their IP addresses may be stored on the basis of my legitimate interests in accordance with Art. 6 (1) (f). EUDATAP for 7 days. This is for my safety, if someone leaves illegal contents in comments and contributions (insults, forbidden political propaganda, etc.). In this case I can be prosecuted for the comment or contribution and I am therefore interested in the identity of the author. The data will then be used to identify and track the author in order to initiate appropriate legal action.

Furthermore, I reserve the right, on the basis of my legitimate interests in accordance with Art. 6 para. 1 lit. f. EUDATAP to process user information for the purpose of spam detection.

On the same legal basis, I reserve the right, in the case of surveys, to store the IP addresses of users for the duration of the surveys and to use cookies in order to avoid multiple votes.

The data provided in the context of comments and contributions will be permanently stored by me until the user objects.

Making contact

When contacting me (e.g. by e-mail, telephone or via social media), the user's details are used for processing the contact request and its handling in accordance with Art. 6 Para. 1 lit. b) EUDATAP. User information can be stored in a customer relationship management system ("CRM system") or by means of a similar request handling mechanism.

I will delete the requests, if they are no longer necessary. I will review the necessity every two years. The legal archiving obligations apply.

Contact form

If you send me enquiries using the contact form, your details from the contact form, including the contact data you provided there, will be stored for the purpose of processing the enquiry and for the case of follow-up requests. I will not pass this data on without your consent.

The data entered in the contact form is therefore processed exclusively on the basis of your consent (Art. 6 para. 1 lit. a EUDATAP). You can revoke this consent at any time. All you need to do is send me an informal e-mail. The legality of the data processing processes carried out up to the revocation remains unaffected by the revocation.

The data entered by you in the contact form remain with me until you request me to delete, until you withdraw your consent to the storage or until the purpose for the data storage ceases to apply (e.g. after your request has been completely processed). Mandatory legal provisions - in particular retention periods - remain unaffected.

Newsletter

With the following guidelines I inform you about the contents of my newsletter as well as the registration, dispatch and statistical evaluation procedure and your rights of objection. By subscribing to my newsletter, you agree to the receipt and the described procedures.

Contents of the newsletter:

I will send newsletters, e-mails and other electronic notifications containing advertising information (hereinafter "newsletters") only with the consent of the recipients or with a legal permission. If the contents of a newsletter are specifically described within the scope of a registration, they are crucial for the consent of the users. In addition, my newsletters contain information about my services and me.

This way I can inform you about me and my services. If you want to receive the newsletter, I need your valid email address as well as information that allows me to check that you are the owner of the given email address or that the owner of the email address agrees to receive the newsletter. Furthermore, I ask for your first and last name for the personalization of my newsletter, which is a voluntary entry.

I do not collect any other data. I use this data only for sending the newsletter. I will not pass it on to third parties.

Double opt-in and logging: The subscription to my newsletter is carried out using a so-called double opt-in procedure. This means that after registration you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that no one can log in with other people's e-mail addresses.  Subscriptions to the newsletter are logged in order to be able to prove the registration process according to legal requirements. This includes the storage of the login and confirmation time, as well as the IP address. The changes to your data that are stored with the mail service provider are also logged.

The dispatch of the newsletter and the success measurement associated with it are carried out on the basis of the recipient's consent pursuant to Art. 6 para. 1 lit. a, Art. 7 EUDATAP in conjunction with § 7 para. 2 no. 3 UWG (Gesetz gegen den unlauteren Wettbewerb - Unfair Competion Act) or, if consent is not required, on the basis of my legitimate interests in direct marketing pursuant to Art. 6 para. 1 lt. f. EUDATAP in conjunction with Section 7 para. 3 UWG.

The registration procedure is recorded on the basis of my legitimate interests pursuant to Art. 6 para. 1 lit. f EUDATAP. I am interested in the use of a user-friendly and secure newsletter system that serves both my business interests and the expectations of the users and which also allows me to prove your consent.

Cancellation/Revocation - You can cancel the receipt of my newsletter at any time, i.e. revoke your consent. You will find a link to cancel the newsletter at the end of each newsletter. I can store the e-mail addresses that you have cancelled for up to three years on the basis of my legitimate interests before I delete them in order to be able to prove a previously given consent. The processing of such data is limited to the purpose of a possible defence against claims. An individual request for deletion is possible at any time, provided that at the same time the former existence of a consent is confirmed.

Mailing service provider (email tool)

I use the platform 'Prosite' of Speedbone Internet & Connectivity GmbH, Alboinstraße 36-42, 12103 Berlin, for the newsletter dispatch and the contact form.

When you register for the newsletter or contact me, Prosite stores your IP address and the date of registration. This storage serves solely as proof in the event that a third party misuses an e-mail address and registers for receiving the newsletter without the knowledge of the authorized party.

You can revoke your consent to the storage of the data, the e-mail address and its use for sending the newsletter at any time. You can unsubscribe either via a link in the newsletter itself, in your profile area or by sending a message to the contact options listed on this website.

The mailing service provider is used on the basis of my legitimate interests according to Art. 6 Para. 1 letter f EUDATAP and an order processing contract according to Art. 28 Para. 3 S. 1 EUDATAP.

The mailing service provider can use the recipient's data in pseudonymous form, i.e. without being associated with a user, to optimize or improve its own services, e.g. to technically optimize the dispatch and presentation of the newsletter or for statistical purposes. However, the mailing service does not use the data of my newsletter or email  recipients to contact them himself or to pass the data on to third parties.

Web forms

When collecting data via the web forms on this site, the IP address of the sender is stored in addition to the information in the form for reasons of legal security. The IPs are not transmitted to the recipient by e-mail, but are stored at the provider.

My online presences in the social media

I maintain various online presences within social networks and platforms to communicate with users, who are active there, and to inform them about my interests and services. When accessing the respective networks and platforms, the terms and conditions and the privacy policies of the respective operators apply.

Unless otherwise stated in my privacy policy, I only process the data of users communicating with me, if they communicate with me within social networks and platforms, e.g. if they write articles on my online presences or send me messages.

On the basis of my legitimate interests (i.e. interest in the analysis, optimization and economic operation of my online offer within the meaning of Art. 6 para. 1 lit. f. Universal Analytics allows me to analyze the activities on my pages across devices (e.g. for access via laptop and later via a tablet). This is made possible by the pseudonymous assignment of a user ID to a user. Such an assignment occurs, for example, when you register for a customer account or log into your customer account. However, no personal data will be forwarded to Google. Even if Universal Analytics adds additional features to Google Analytics, this does not mean that it restricts privacy measures such as IP masking or the browser add-on.

Privacy policy for the use of Google AdSense

On the basis of my legitimate interests (i.e. interest in the analysis, optimization and economic operation of my online offer within the meaning of Art. 6 para. 1 letter f. EUDATAP) I am using Google AdSense, an ad serving service provided by Google Inc. "("Google"), 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google").

I use the AdSense service, which can be used to display ads on my web pages and potentially pay for their display or other use. For these purposes, usage data such as the click on an advertisement and the IP address of the user are processed, whereby the IP address is shortened by the last two digits. Therefore, the processing of the user's data is pseudonymised.

Google AdSense uses "cookies", which are text files placed on your computer, to help analyze the use of the website. Google AdSense also uses so-called web beacons (invisible graphics). These web beacons can be used to evaluate information such as visitor traffic on these pages. The information generated by cookies and web beacons about the use of my website (including your IP address) and delivery of advertising material will be transmitted to and stored by Google on servers in the United States. This information may be passed on by Google to Google's contractual partners. However, Google will not merge your IP address with other data stored about you.

I use AdSense with non-personalized ads. The ads are not displayed on the basis of user profiles. Non-personalized ads are not based on previous user behavior. The targeting process uses contextual information, including rough (e.g. at the local level) geographical targeting based on the current location, the content of the current website or app, and current search terms. Google prevents any personalized targeting, including demographic targeting and targeting based on user lists.

Integration of third-party services and content

Within the scope of my online offer, on the basis of my legitimate interests (i.e. interest in the analysis, optimization and economic operation of my online offer within the meaning of Art. 6 para. 1 lit. f. EUDATAP), I am using content or service offers by third parties to incorporate their content and services, such as videos or fonts (hereinafter uniformly referred to as "content").

This always presupposes that the third party providers of this content will detect the IP address of the users, as they would not be able to send the content to their browser without the IP address. The IP address is therefore required for the display of this content. I am trying to use only those contents, whose respective providers use the IP address only for the delivery of the contents. Third-party providers may also use so-called pixel tags (invisible graphics, also known as "web beacons") for statistical or marketing purposes. Pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. Google reCAPTCHA

I use "Google reCAPTCHA" (hereinafter "reCAPTCHA"), a function for detecting bots on my websites. Provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

Using reCAPTCHA it is intended to check whether the data entry on my websites (e.g. in a contact form) is done by a person or by an automated program. For this purpose reCAPTCHA analyzes the behavior of the website visitor on the basis of different characteristics. This analysis starts automatically as soon as the website visitor enters the website. For the analysis reCAPTCHA evaluates various information (e.g. IP address, duration of stay of the website visitor on the website or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses are completely carried out in the background. Visitors to the website will not be informed that an analysis is taking place.

Data processing is carried out on the basis of Art. 6 para. 1 lit. f EUDATAP. I have a legitimate interest in protecting my web offers from abusive automated spying and SPAM.

Google Web Fonts

This website uses so-called web fonts provided by Google to uniformly display fonts. When you call up a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.

To do this, the browser you are using must connect to Google's servers. This will inform Google that my website has been accessed via your IP address. The use of Google Web Fonts is in the interest of a uniform and appealing presentation of my online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f EUDATAP.

If your browser does not support web fonts, your computer will use a default font instead.

OpenStreetMap

I embed the maps of the service "OpenStreetMap", which are offered on the basis of the Open Data Commons Open Database License (ODbL) by the OpenStreetMap Foundation (OSMF). Link to Privacy Policy.

As far as I understand, OpenStreetMap will only use user data for the purpose of displaying map functions and temporarily storing the selected settings. This data may include in particular the IP addresses and location data of users, but may not be collected without their consent (which is usually obtained as part of the settings of their mobile devices).

Multilingualizer-SCript

This website uses a script to display different languages, which is provided online. When you call up a page, your browser loads the required script to display texts only in the desired language.

The Multilingualizer stores a single cookie on users browsers called ‘language’. This cookie is in compliance with GDPR rules for remembering ‘language or font preferences’. It is used to remember, which language the user has chosen so the correct language text can be shown as users move from page to page. The cookie is stored on user's browsers for 30 days.

No personal data is transmitted. The use of the Multilingualizer script is in the interest of a multilingual presentation of my online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f EUDATAP.

For the display and archiving of images and photos I use Squarespace (see above) and the services "Flickr" and "SmugMug".

The hosting services used by me serve the provision of the following services:

Infrastructure and platform services, computing capacity, storage space and database services, e-mail delivery, security services and technical maintenance services that I use for the purpose of operating this online offer.

In doing so, I and my hosting providers process inventory data, contact data, content data, contract data, usage data, meta- and communication data of customers, interested parties and visitors of this online offer on the basis of my legitimate interests in an efficient and secure provision of this online offer according to Art. 6 Para. 1 lit. f EUDATAP in conjunction with. Art. 28 EUDATAP (contract for order processing).

Server-LogFiles

I, or my hosting provider, collect personal data on the basis of my legitimate interests within the scope of Art. 6 para. 1 letter f. EUDATAP on each access to the server on which this service is located (so-called server log files). Access data includes the name of the accessed website, file, date and time of access, transferred data volume, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider.

These data cannot be assigned to specific persons and will not be merged with other data sources. I reserve the right to check these data subsequently if I become aware of concrete indications of an illegal use.

Log file information is stored for a maximum of 7 days for security reasons (e.g. to investigate abuse or fraud) and will then be deleted. Data whose further storage is required for evidentiary purposes are excluded from deletion until the respective incident has been finally clarified.
